Touching the private part of a small child breaks ablution or not? In particular, women have to touch their hands while cleaning or washing the child, so does this maintain or break their ablution? Among the two opinions of the scholars in this regard, the most common one is that touching the private parts of a small child does not break the wudhu, that is, if someone is performing ablution and during that time the child has to be cleaned etc., which touches his private parts. If it is applied, it does not affect the ablution, but the ablution remains intact and correct.
The explanation is that the private part of a child is not forbidden by adults, for example, it is forbidden to see or touch the private part of an adult with the exception of spouses, while it is not forbidden to see the private part of a small child, they can see it when necessary. As Shaykh al-Islam Ibn Taymiyyah, may Allah have mercy on him, says:
Awrah al-Saghir has no rule, so it is permissible to wipe it.
"The private part of a small child has no command, so it is permissible to touch it." (1)
Allama Mardawi, may Allah have mercy on him, says:
It is not forbidden to look at the private parts of the child and the child before the age of seven, nor to touch it, according to the text of Imam Ahmad.
"It is not haram to see or touch the private parts of a child younger than seven years of age, this issue is proven by Imam Ahmad, may Allah have mercy on him." (2)
Imam Ibn Qudama, may Allah have mercy on him, has narrated with reference to Imam Zuhri and Uza鈥檌, may Allah have mercy on him:
Do not perform ablution on the person who misses the young man because it is permissible to touch him and look at him.
"Touching the private parts of a small child does not constitute wudhu because it is permissible to touch or look at it." (3)
Sheikh Muhammad bin Saleh al-Uthaymeen may Allah have mercy on him says:
According to the jurists, there is no rule for a woman except the seven sunnahs, but a woman is like her hand, so it is permissible to look at her, and she does not haraam a mustache.
According to the jurists, there is no ruling on the private part of a child under seven years of age, but it is like his hand, so it is permissible to look at it and it is not forbidden to touch it. (4)
