Poloniex changes its terms and conditions moments before the Bitcoin "split"!

An alert has appeared on Poloniex about changes to its terms of use.
Wow! Is Poloniex trying to get away with something here? Bitcoins are already locked in - you can't transfer them, so when before some Poloniex users might have thought that there would be an obligation for Poloniex to share Bitcoin Cash, these new terms and conditions may change that.
In saying that, I haven't had time to see what has actually changed. I have a feeling it may be something to do with class action lawsuits and only being allowed to sue individually (pic 3).
