Hi steemians friends, sexual harassment within the workplace seems to be considered a taboo subject for some officials whose duty is to defend the victim.

We are concerned that those who are envestidos by law to be guarantors of the rights of citizens are turned a blind eye to some abuses or simply decide to downplay and not address them because they would recharge work or will they ignore the regulatory framework or the characteristics of what sexual harassment or harassment represents? If so, let's take a look at the legal framework related to the topic: we have that the Organic Law on Prevention, Conditions and Environment in the Work establishes the obligation of the employer to take the appropriate measures to avoid any form of sexual harassment and design a policy aimed at eradicating sexual harassment in the workplace; The Organic Law on the Right of Women to a Life Free of Violence considers sexual harassment as a form of violence against women and constitutes a crime that generates compensation for victims who suffer it, and imprisonment and fines for who or who they execute it. This law against female violence establishes a series of situations that can be considered acts of violence against women, and that can be executed in the course of work.

On the other hand, the law defines sexual harassment as the request of any act or behavior of sexual content, for oneself or for a third party, or seeking any type of unwanted sexual approach that a man makes by prevailing a situation of labor superiority ; the Organic Labor Law incorporates the definition of sexual harassment and grants the victim the possibility of justifiably withdrawing from the job, as well as to the company the faculty to justifiably dismiss the offender, provided he has proof of this.

Sexual harassment is sexual conduct that is unwanted, unwelcome and unsolicited. For further clarification let's see some examples of sexual harassment: Pats, pinches, patting, squeezing or deliberate rubbing; gestures with a sexual connotation; Forcing women to work outside normal hours, which could expose them to certain hazards during their commute to work; trying or forcing the working woman to perform certain jobs in the office of the hierarchical superior.

I am worried about workers who decide to report certain abuses of their bosses and those who should attend them only tell them: that does not fall within the crime of sexual or labor harassment; Oh my God!.
