we wish to inform all members of a CEASE & DESIST order received from Securities Commissioner for the State of South Carolina USA.

1. Swiss Gold Global and Genesis Mining Ltd are named as the respondents in the Cease & Desist Order.

2. Both Swiss Gold Global and Genesis Mining Ltd have 30 days to respond to the Cease and Desist Order from the time of serving. We are aware of this through the internet but have not yet legally been served the notice.

3. Swiss Gold Global and Genesis Mining Ltd (this is not to be interpreted as an official response from Genesis Mining Ltd) intentions are always to perform our duties in good faith and within the law.

4. Any comments or references made here is not a legal statement as we the company have not received legal counsel regarding this Cease and Desist Order and therefore this information at this time is for information purposes.

5. Summary of Cease & Desist Order as per IV. CONCLUSIONS OF LAW

a. The South Carolina Uniform Securities Act of 2005, S.C. Code Ann. 35-1-101, et seq., governs the offer and sale of securities in this State. (South Carolina USA)
Pursuant to S.C. Code Ann. 35-1-102(29), investment contracts constitute securities, and an investment contract includes an investment of money in a common enterprise with the expectation of profits to be derived primarily from the efforts of a person other than the investor.
Pursuant to S.C. Code Ann. 35-1-301, it is unlawful for a person to offer or sell a security in this State (South Carolina, USA) unless that security is a federal covered security, exempt from registration, or registered.

b. The Mining Contracts offered and sold by the Respondents constitute investment contracts and are thus securities as defined by the Act.

c. In connection with the events above, Respondent Swiss Gold Global transacted business in this State as an unregistered broker-dealer in violation of S.C Code Ann. 35.1.401(a).

1. V. CEASE AND DESIST ORDER
   NOW THEREFORE, pursuant to S.C. Ann. 35-1-604(a)(1), it is hereby ORDERED that:
   a. Respondent Swiss Gold Global and every successor, AFFILIATE, control person, agent, servant, and employee of Swiss Gold Global, and every entity owned, operated, or indirectly or directly controlled by or on behalf of Swiss Gold Global, CEASE AND DESIST from transacting business in this State (South Carolina) in violation of the Act.
   In accordance with the Cease and Desist Order Swiss Gold Global will immediately make the initial actions and subject to legal advice as we have not yet been served the Cease & Desist Order;
   I. Swiss Gold Global will “Prohibit and block all IP addresses” in the state of South Carolina, USA and no products or services to be sold.
   II. In accordance with Swiss Gold Global “KYC” (Know Your Customer) policy, proof of address such as a utility bill will be required supporting a USA registered member
   III. All Swiss Gold Global Members, Free Customer and Affiliate Members MUST immediately stop doing any Swiss Gold Global / Genesis Mining business in this state or you will be subject to breach of the Security Laws of South Carolina, USA which will carry a harsh penalty
   Further necessary actions may be taken pending future legal advice.
   DO NOT be in breach of this CEASE & DESIST ORDER!
