They are attacking cryptocurrencies considering them as "values", comparing them as if they were shares of a company, some property or that they grant governance.

Sounds ridiculous right?

The difference in considering a cryptocurrency as a "security" is basically due to the fact that these "securities" are strictly regulated, so operating with them without a special permit is considered illegal in the United States.

But let's face it, for them to come up with this ridiculous business is not normal.

But what if Gary decides to create a multi-million dollar order tomorrow to buy Hive for $0.1 and then decides to list it? I don't think many people decide to sell, but lowering the price for sure.

That is what he is mainly accused of manipulating the market to make money.

Now, back to the subject of malicious persecution, because if market manipulation is proven, malicious persecution would pretty much be another criminal charge.

• Sue without probable cause - his arguments are based on his opinion (although we have already seen that 2 years ago he thought otherwise) and are not based on real facts, therefore this point is fulfilled.

• Sue with malicious intent - although Gary is presumably acting in his favor, he knows the consequences and that implies malicious intent.

• Sue to cause damage - of course it has caused damage, both to the reputation of the defendants and to anyone who has cryptocurrencies and has seen their price drop due to the alleged market manipulation

• That the damage exists and can be demonstrated - it is obvious that the damage exists and 100% demonstrable if evidence of the alleged manipulation appears.

• Quereis ver mas hipocresia aún? Pocos días antes de ser presidente de la SEC, el propio Gary dijo que la SEC no tiene autoridad para regular las "criptodivisas".

• Otro dato curioso es que Coinbase pidió formalmente una pauta reglamentaria sobre el sector de activos digitales a la cual la SEC no dio respuesta, y tiempo después un tribunal tuvo que ordenarle dar una respuesta a Coinbase.

Entonces, Coinbase no quiere cumplir la ley o Gary no quiere que Coinbase cumpla la ley?

Según dice Gary, y el ejemplo que pone sobre criptomonedas que ofrecen gobernanza, según la teoria de este señor, comprar Hive es lo mismo que comprar acciones de Apple. Con esta teoría si alguna vez has comprado Hive en Binance ha sido de manera ilegal.

Aunque es cierto que Hive no aparece en la lista mencionada, es simplemente por el hecho de que no es una criptomoneda muy conocida a nivel mundial.

¿Pero si Gary mañana decide crear una orden de muchos millones de dolares para comprar Hive en 0,1$ y después decide incluirla en la lista? No creo que mucha gente decida vender, pero hacerla bajar de precio, acabará bajando seguro.

De eso se le acusa principalmente, de manipular el mercado para ganar dinero.

Ahora bien, volvamos al tema de la persecución maliciosa, porque si se demuestra la manipulación del mercado, prácticamente la persecución maliciosa sería otro cargo criminal.

• Demandar con falta de causa probable - sus argumentos se basan en su opinión (aunque ya hemos visto que hace 2 años opinaba lo contrario) y no se basan en hechos reales, por tanto este punto si lo cumple.

• Demandar con intención maliciosa - aunque presuntamente Gary actua a su favor, sabe las consecuencias y eso implica una intención maliciosa.

• Demandar para/que causar/causen daño - desde luego que ha causado daño, tanto a la reputación de los demandados y a todo aquel que tenga criptomonedas y ha visto bajar su precio por la presunta manipulacion de mercado

• Que exista el daño y se pueda demostrar - es obvio que existe el daño y 100% demostrable si aparecen las pruebas de la supuesta manipulación.

He hecho mi propia investigación y este es el resumen de lo mas destacable, me hubiera gustado sacarlo el mismo día que ocurrieron los hechos, pero he decidido ir mas despacio y contrastando informacion en varios sitios webs para mantener la información mas veraz posible.
