But are the authors correct in their assessment? Given the regulatory uncertainty in the U.S., one can certainly answer "yes" to this question. However, a deeper look into the numbers is warranted.
A significant portion of the record fines from 2024 comes from a single actor: Terraform Labs, the company behind the collapsed Terra (LUNA) ecosystem, and its founder Do Kwon. In June, the SEC imposed a fine of $4.678 billion on Terraform Labs. Previously, a jury found Kwon and Terraform Labs guilty of deceiving investors and lying about the stability of their in-house stablecoin UST.
If we exclude the fine against Terraform Labs, approximately $8.5 million in fines remain that the SEC imposed on other crypto companies. This averages out to a fine of around $850,000. Compared to the data from the previous year, this actually represents an 83 percent reduction. Excluding Terraform Labs, the SEC has imposed fewer fines in 2024 than in the six years prior.
This is partly due to the fact that the U.S. regulator has suffered several defeats in court. Most recently, this includes the case against Ripple, although a retrial of the process is currently looming.
Additionally, the volume of fines this year could still increase further. The SEC recently targeted the NFT marketplace OpenSea. Experts consider it likely that the case will go to court. However, it remains to be seen how much money the SEC will demand from the NFT marketplace.
