It all worked out for the best in the end as far as "lawyering" goes, if I had gone to school and passed the BAR examine it would all been wasted time and money.
The reason is the oath lawyers have to take. It basically says that your primary function is to hold up the integrity of the court, and you will demean yourself as necessary in order to that. Nothing about doing what is right, legal, lawful, ethical or even that your client should be a priority to you.
It basically says,"we own the game and if want a piece of OUR pie you will do as we say and shut up.'
Most law school grads are 6 to 8 years in education and tens of thousands in debt before they even see that oath, they have no choice but to sign it and sell their soul to the court.
I could have never signed an oath like that.
So if you ever have to hire a lawyer.... keep in mind that your best interest is not his priority, his is to the court and the bar or they will kick his ass out of their club.
Rulings like the one you cited in that story are the exact reason "fully informed juries" are needed.
If that same supreme court told you that you had to jump out of a plane with no parachute would you?... I think we know the answer is NO. The courts won't tell people what their rights as jurors are, they will only tell you to judge the facts of the case and not the law.
Civil disobedience is needed in every courtroom in this country for the most part. It is our duty to make sure real "justice" takes place and if you can't apply common sense and your conscience how can justice take place?
