Apart from being able to assist the parties in the proceedings, the advocate can also bridge the dialogue between the parties who will divorce in relation to agreements, such as property, family allowances, child custody, and other important matters.
The legal basis of the divorce process in Indonesia is Law No. 1 of 1974 concerning Marriage and Government Regulation Number 9 of 1975. Based on the Act, it is possible for one party, namely husband or wife to file a divorce. Nevertheless, there is a difference between adherents of Islam and outside of Islam in this matter of divorce.
Muslim couples can get divorced by an application for divorce by the husband or divorce by the wife registered with the religious court. For non-Muslim couples can divorce by filing for divorce (both husband and wife) through the district court.
