When an elderly person loses their savings through phishing do you say nothing was stolen then?

Do you own something if you can't control it?

If OpenSea can freeze the ability to trade it, do you really own it? What does that do to the value of the NFT? What is to stop them doing the same to someone else where the case isn't so clear cut, who do you turn to?

I thought this libertarian future of code over lawyers was meant to mean we didn't have to turn to the traditional legal and law enforcement systems to litigate these things?
