I think this is exactly what will happen:

Moving forward with the change and how that is done should be done on a separate proposal.

Also on the bylaws, maybe Clay can get you in touch with the law firm. This proposal is simply a first step so that there is someone that has the authority of the SPS DAO to do what is necessary to establish a new foundation.
