oh there are certain things about the castle doctrine that are nitpicky like that. You also are not supposed to shoot anyone in the back but as it turns out that isn't necessarily true. If they were in your yard running away from your house and you shot them in the back that would be a different situation.

I don't often hear about any people getting prosecuted (in North Carolina) for utilizing the Castle Doctrine protections but I think that your prior criminal history and other factors would come into play. If the person who is in the home has no record and the person who got shot does, well that speaks volumes in the eyes of the judges here in this state.
