All the new developments have been good for us: from a return to boom times, DeFi, lots of other anti-trust cases against Facebook & Google; Facebook being found to be subject to Australian law for overseas activities; the Aussie government going after Google and Facebook, even COVID!
The clearest case for damages has always been for people who sold at lower prices so higher prices now are not relevant from that perspective. But they prove it wasn't a bubble. Also many alts (incl Steem) are still well below their ATHs.
The DeFi driven ETH boom proves that the ICO boom was no fluke. ETH prices are driven by smart contract usage for big $.
We have no intention of filing a case in the US.
We are suing Facebook Inc and Google LLC in Australia for their worldwide conduct and then will enforce the judgement all over the world against their assets it they don't pay up.
The US isn't the only country able to exercise extra-territorial jurisdiction.
Many class actions take 10+ years to finalise. Some are not brought until just before 6 year limitation period expires. 2.5 years to file proceedings is not long and 4 hearings in 6 months is quite good.
