Does it hurt the case that prices of many of these things are back to their highs or higher than they were back then? The judge may look at it, and be like meh, so it caused some volatility, it didn't ultimately alter the trajectory.

Seems like the case was easier to make when things were on the lows and looking like the bans killed everything...

I mean we are now 3 years later and you still haven't even filed in the US yet, how long this is taking might cause you to miss your window...
