Autonomous cars are already among us, as is artificial intelligence, which is gradually gaining more and more space in society. We know that the future seems to be taking us to a time when cars will all be independent, like in the movies. Get in, decide on a destination and that's it, the car will go wherever you choose. This seems really cool and I confess that I've been tempted for the past day, maybe if I can, I'll buy one of these cars.
But, like many things in life, we have to regulate and have rules about everything that can happen, whether good or bad. So what is or should the legislation be regarding these cars? Well, it's a very interesting question, asking to Google and now its artificial intelligence, it answered me the following:
There is no clear definition of who is responsible for an accident with a self-driving car, but the responsibility is usually attributed to the driver when he or she is not paying attention or does not responds to vehicle alerts.
Civil liability for damages caused by autonomous vehicles can be clarified by analyzing the circumstances of the accident, especially when it comes to level 5 autonomous vehicles, in which automation is complete.
A car Autonomous is a vehicle that takes control of the driving almost completely, can operate alone and has the ability to make decisions thanks to artificial intelligence. However, you can still ask the driver for help at times.
Here it is already said that the responsibility lies with the driver in the car, But, I keep wondering if the car drives itself, why is the driver, who is more like a passenger, held responsible? It shouldn't be that way, should it? In my view, I am not responsible for the car. Of course, I can take control if something is about to happen or if I want to drive manually. However, if the car is autonomous and still needs humans, it seems to me that there is an inconsistency in this.
Maybe because we are still far from the ideal point, so when the evolution of autonomous cars reaches a level where they really do not need humans, the problem caused by an accident with or without fatality will be entirely attributed to the company that created it. Just like a home appliance, imagine that you buy a brand new blender, get home and turn it on to blend milk with banana and its peripheral simply explodes or doesn't work, it's not your fault, it was the company that made it and put it on sale with a defect !
So, self-driving cars also have to be seen as a product, I think that's how it should be, so you need to create a product that can meet the expectations of the place where it will operate and things like that. Of course, this is a very simplistic idea and, more logically, it is good to have a human being able to do something in an emergency, better than a car alone killing someone by being run over or causing a lot of damage.

Although in Brazil, we have a lot of problems with the roads and streets, so I don't know if it would be interesting to have one, due to the lack of infrastructure, things that happen in a third world country, unfortunately we are prone to this. So having this convenience would be really cool.
I believe it will still take time, so until then, we can only think, whether for distribution or financial reasons, maybe in the future we will be able to have access to a “popular” autonomous car, who knows, nothing is impossible for the future that is coming to us all.

Os carros autônomos já estão entre nós, assim como a inteligência artificial que gradualmente vai conquistando cada vez mais espaço na sociedade, sabemos que o futuro parece nos levar para um momento em que os carros serão todos independentes, como nos filmes, vamos entrar, decidir um destino e pronto, o carro irá sozinho para onde escolhemos. Isso parece ser bem legal e confesso que fico tentado há um dia quem sabe, se conseguir, comprar um destes carros.
Mas, assim como muitas coisas nessa vida, temos que regulamentar e ter regras sobre tudo aquilo que pode acontecer, seja bom ou ruim. Então como é ou como deveria ser a legislação em cima destes carros? Bem, é uma questão bem interessante, perguntando ao Google e agora a sua inteligência artificial, ela me respondeu o seguinte:
Não há uma definição clara sobre quem é o responsável por um acidente com um carro autônomo, mas a responsabilidade é normalmente atribuída ao motorista quando ele não presta atenção ou não responde aos alertas do veículo.
A responsabilidade civil dos danos causados por veículos autônomos pode ser esclarecida analisando as circunstâncias do acidente, especialmente quando se trata de veículos autônomos de nível 5, nos quais a automação é total.
Um carro autônomo é um veículo que assume o controle da direção quase que totalmente, pode operar sozinho e tem capacidade para tomar decisões graças à inteligência artificial. No entanto, ainda pode solicitar a ajuda do motorista em alguns momentos.
Aqui já é dito que a responsabilidade fica em cima do motorista no carro, mas, eu fico me perguntando se o carro dirige sozinho, porque o motorista, que está mais para um passageiro, é responsabilizado? Não deveria ser assim, deveria? Na minha visão não sou eu que sou responsável pelo carro, claro que posso assumir o comando caso algo esteja para acontecer ou caso queira dirigir manualmente, mas, se o carro é autônomo e mesmo assim ainda precisa dos humanos, me parece haver uma inconsistência nisso.
Talvez porque ainda estamos longe do ponto ideal, então quando a evolução dos carros autônomos chegarem a um patamar que realmente não precisem dos humanos, o problema causado por um acidente com fatalidade ou não seja totalmente atribuído a empresa que o criou. Assim como um eletrodoméstico, imagine que você compra um liquidificador novinho, chega em casa e liga ele para bater leite com banana e o seu periférico simplesmente explode ou não funciona, a culpa não é sua, foi a empresa que o fez e o colocou à venda com defeito!
Então, os carros que dirigem sozinhos também tem que ser vistos como um produto, acho que é assim que deveria ser, então você precisa criar um produto que consiga corresponder com as expectativas do lugar onde irá funcionar e coisas do tipo. Claro que isso é uma ideia bem simplista e sendo mais logico, é bom mesmo ter um humano para conseguir fazer algo em um caso de emergência, melhor isso do que um carro sozinho matar alguém atropelado ou causar muitos prejuízos.
UnsplashDe qualquer forma, da vontade de comprar um, ainda mais que no trânsito no horário de pico, tudo costuma ser bem desgastante, então um carro que sozinho consiga fazer tudo seria ótimo. Apesar de que no Brasil, temos muitos problemas com as estradas e ruas, então não sei se seria interessante ter um, por falta de infraestrutura mesmo, coisas de país de terceiro mundo, infelizmente estamos propícios a isso. Então ter essa comodidade seria bem legal.
Acredito que ainda levará tempo, então até lá, apenas podemos pensar, seja por questão de distribuição ou financeiras, talvez no futuro consigamos ter acesso a um carro autônomo “popular”, quem sabe, nada é impossível para o futuro que está vindo a todos nós.
