La protección de la propiedad intelectual es esencial en todos los ámbitos, incluso en un entorno profesional donde puede surgir el plagio interno. En este escrito, compartiré mi experiencia de ser víctima de plagio por parte de un superior jerárquico y cómo enfrenté esta situación. Aunque pueda parecer innecesario protegerse entre colegas de confianza, mi experiencia demuestra la importancia de salvaguardar nuestros derechos y superar los obstáculos que puedan surgir.

Hace unos años, realicé un trabajo complejo en una de las instalaciones de mi empresa. Como parte del proceso, debíamos presentar informes al Departamento de Supervisión del organismo superior para su revisión. Al día siguiente, nos devolvían los informes y, si era necesario hacer alguna aclaración para una mejor comprensión, con lo que asi se concluía nuestro intercambio.
Sin embargo, pocos días después, la Dirección de mi empresa recibió un informe del órgano superior en el que se reflejaba todo el trabajo realizado por mí, pero firmado por el Jefe del Departamento de Supervisión, como si se tratara de un trabajo realizado por esa institución y no por nuestra empresa internamente.
A few years ago, I performed complex work at one of my company's facilities. As part of the process, we were required to submit reports to the higher agency's Oversight Department for review. The next day, the reports were returned to us and, if necessary, clarifications were made for better understanding, thus concluding our exchange.
However, a few days later, the Management of my company received a report from the superior body reflecting all the work done by me, but signed by the Head of the Supervision Department, as if it were work done by that institution and not by our company internally.
En una reunión con el Director de la empresa, se aclaró la situación presentando todos los elementos y documentos que tenía a mi disposición, demostrando que el trabajo fue realizado por mí y con la colaboración de mis compañeros. Esta situación me causó un enorme daño, ya que perdí la confianza que tenía en los supervisores. Me sentí profundamente decepcionada y esa sensación de tristeza me afectó durante mucho tiempo. No entendía cómo un órgano de control podía cometer un acto tan carente de ética. A partir de ese momento, ya no me sentía segura al entregar informes, lo cual aumentaba mi tristeza, ya que el ambiente de confianza y camaradería se había roto definitivamente.
Afortunadamente, mi jefe, que conocía bien mi estilo de trabajo, respaldó mi reclamo y presenté pruebas irrefutables que demostraban que el trabajo era mío. Esto disipó cualquier duda y se reconoció mi autenticidad en la realización del informe. A pesar del resultado final, el proceso fue muy doloroso para mí, ya que tuve que enfrentar una carga emocional intensa y experimentar una sensación de impotencia inmensa. No podía entender cómo un compañero de trabajo podía actuar de esa manera. Me sentí indignada y herida durante un tiempo y solo pude hablar de este suceso con unas pocas personas, ya que me sentía abrumada e incapaz de abordar semejante actitud. Sentía que los valores éticos se habían desvanecido por completo.
In a meeting with the Director of the company, the situation was clarified by presenting all the elements and documents that I had at my disposal, demonstrating that the work was done by me and with the collaboration of my colleagues. This situation caused me enormous damage, since I lost the trust I had in the supervisors. I felt deeply disappointed and that feeling of sadness affected me for a long time. I did not understand how a control body could commit such an unethical act. From that moment on, I no longer felt confident in handing in reports, which increased my sadness, as the atmosphere of trust and camaraderie had definitely broken down.
Fortunately, my boss, who knew my work style well, backed up my claim and I presented irrefutable proof that the work was mine. This dispelled any doubts and my authenticity in the completion of the report was acknowledged. Despite the final outcome, the process was very painful for me, as I had to face an intense emotional burden and experience an immense sense of helplessness. I could not understand how a co-worker could act in such a way. I felt outraged and hurt for a while and could only talk about this event with a few people, as I felt overwhelmed and unable to deal with such an attitude. I felt that ethical values had completely vanished.
Esta experiencia me llevó a reflexionar y aprender valiosas lecciones. Aprendí la importancia de ser proactivo, es decir, actuar rápidamente para evitar complicaciones futuras en la protección de la propiedad intelectual, incluso en situaciones donde la confianza y la jerarquía parecen garantizarla.
Por eso, los animo a tomar medidas para proteger sus creaciones incluso cuando se trabaja con personas de confianza. Recomiendo mantener registros de todos los trabajos realizados, recopilar información de terceros para respaldar el desarrollo del trabajo y asegurarse de que cada documento entregado esté firmado por las partes involucradas, como evidencia de autoría. Además, es importante establecer acuerdos de confidencialidad, crear copias de seguridad de los archivos y realizar un seguimiento de las fechas y versiones de las creaciones.
This experience led me to reflect and learn valuable lessons. I learned the importance of being proactive, that is, to act quickly to avoid future complications in the protection of intellectual property, even in situations where trust and hierarchy seem to guarantee it.
Therefore, I encourage you to take steps to protect your creations even when working with people you trust. I recommend keeping records of all work performed, collecting information from third parties to support the development of the work and making sure that each document delivered is signed by the parties involved, as evidence of authorship. In addition, it is important to establish confidentiality agreements, create backup copies of files and keep track of dates and versions of creations.
