Is the FCC is not the right agency to be regulating the internet's infrastructure, first and foremost?

The last mile is a real problem, how do we deal with it, we need to maintain infrastructure and there needs to be incentives to build and maintain it, but what's the best way to do this - private industry, government(s), or a mix?
