Interference with privacy is not allowed / Втручання в особисте життя не допускається.

According to Article 32 of the Constitution of Ukraine:
No one may interfere in his personal and family life, except as provided by the Constitution of Ukraine.
The collection, storage, use and dissemination of confidential information about a person without his or her consent is not permitted, except in cases specified by law and only in the interests of national security, economic well-being and human rights.
Every citizen has the right to get acquainted with information about himself in public authorities, local governments, institutions and organizations, which is not a state or other secret protected by law.
Everyone is guaranteed judicial protection of the right to refute inaccurate information about themselves and their family members and the right to demand the removal of any information, as well as the right to compensation for material and moral damage caused by the collection, storage, use and dissemination of such false information.

Article 32 of the Constitution guarantees non-interference in a person's personal and family life, thus the state has provided every citizen with the opportunity to control information about himself and his family, to stop the disclosure of unwanted information. That is, in the sphere of personal life, the relationship between people and the state is based on the principles of morality. The guarantee of non-interference in private and family life is a guarantee of personal and family secrecy, of ensuring the possibility for everyone to be in a state of relative independence from the state and society. The reference to the fact that the state guarantees non-interference in the personal and family life of a person, except as provided by the Constitution of Ukraine, is quite justified.
The concept of information about a person is a set of documented or publicly announced information about him. The main data about the person are: nationality, education, marital status, religion, health status, as well as address, date and place of birth.
Confidential information under its legal regime is information with limited access, which contains information that is in the possession, use or disposal of individuals. Any person who possesses information of professional, business, industrial, banking, commercial and other nature, obtained at his own expense, or which is the subject of his professional, business, industrial, banking, commercial, personal and family interest, and at the same time not violates the secrecy provided by law, independently determines the mode of access to it. Therefore, restrictions on the collection, storage, use and dissemination of confidential information about a person (without his consent), as referred to in Part 2 of Article 32 of the Constitution, are appropriate, because in this case the rights of the person and possible details of his intimate life. Therefore, information that is disclosed without the consent of the person can negatively affect a person's way of life, his family status and many other factors. Only the consent of the person gives the opportunity to dispose of information about him, except in cases of gathering information during the investigation, inquiry and operational and investigative measures.
Among confidential information, information of a professional nature is of special importance. The current legislation provides for strict restrictions on this information and the means of its disclosure. Thus, according to the Law of Ukraine "On the Fundamentals of the Legislation of Ukraine on Health Care" it is stated that medical workers and other persons who in connection with the performance of professional or official duties became aware of the disease, medical examination, examination and their results , intimate and family aspects of a citizen's life, do not have the right to disclose this information, except as provided by law. Similarly, the Law of Ukraine "On Notaries" stipulates that notaries and other officials who perform notarial acts are obliged to observe the secrecy of these actions. The obligation to maintain the secrecy of notarial acts also applies to persons who became aware of these actions in connection with the performance of their official duties. Certificates of notarial acts and documents are issued only at the written request of the court, arbitration court, prosecutor's office, bodies of inquiry and investigation in connection with criminal, civil or commercial cases.
Professional secrets are also considered secrets: confession, trusted priest; judicial protection; preliminary investigation; adoption and more.
The Constitution provides for the right of every citizen to get acquainted with information about himself, which is related not only to the activities of public authorities, local governments, but also institutions and organizations of all forms of ownership. According to Article 31 of the Law of Ukraine "On Information", citizens have the right to access information about them, to deny its correctness, completeness, relevance, etc.
Public authorities, local governments, institutions and organizations that have information about citizens are obliged to provide it directly and free of charge at the request of persons concerned, except as provided by law, and take measures to prevent unauthorized access to it.
Denial of access to or concealment of such information, illegal collection, use, storage or dissemination may be challenged in court. The guarantee for judicial protection of the right to refute false information and demand the removal of any information is supported by the requirements of Article 49 of the Law of Ukraine "On Information". The right to compensation for material and moral damage caused by the collection, storage, use and dissemination of such information is contained in the Civil Code and is guaranteed by Article 56 of the Constitution of Ukraine.

Відповідно до статті 32 Конституції України :
Ніхто не може зазнавати втручання в його особисте і сімейне життя, крім випадків, передбачених Конституцією України.
Не допускається збирання, зберігання, використання та поширення конфіденційної інформації про особу без її згоди, крім випадків, визначених законом, і лише в інтересах національної безпеки, економічного добробуту та прав людини.
Кожний громадянин має право знайомитися в органах державної влади, органах місцевого самоврядування, установах і організаціях з відомостями про себе, які не є державною або іншою захищеною законом таємницею.
Кожному гарантується судовий захист права спростовувати недостовірну інформацію про себе і членів своєї сім’ї та права вимагати вилучення будь-якої інформації, а також право на відшкодування матеріальної і моральної шкоди, завданої збиранням, зберіганням, використанням та поширенням такої неправдивої інформації.

Статтею 32 Конституції гарантовано невтручання в особисте й сімейне життя особи, тим самим держава забезпечила можливість з боку кожного громадянина контролювати інформацію про себе та свою родину, припинити розголос небажаної інформації. Тобто у сфері особистого життя відносини між людьми та державою будуються на принципах моральності. Гарантія невтручання в особисте і сімейне життя — це гарантія на особисту і сімейну таємницю, на забезпечення можливості перебувати кожній людині у стані відносної незалежності від держави й суспільства. Посилання на те, що держава гарантує невтручання в особисте і сімейне життя особи крім випадків, передбачених Конституцією України, цілком виправдане.
Поняття інформації про особу — це сукупність документованих або публічно оголошених відомостей про неї. Основними даними про особу є: національність, освіта, сімейний стан, релігійність, стан здоров'я, а також адреса, дата і місце народження.
Конфіденційна інформація за своїм правовим режимом — це інформація з обмеженим доступом, що містить відомості, які знаходяться у володінні, користуванні або розпорядженні окремих осіб. Кожна особа, яка володіє інформацією професійного, ділового, виробничого, банківського, комерційного та іншого характеру, одержаною на власні кошти, або такою, що є предметом його професійного, ділового, виробничого, банківського, комерційного, особистого та сімейного інтересу, і при цьому не порушує передбаченої законом таємниці, самостійно визначає режим доступу до неї. Тому обмеження щодо збирання, зберігання, використання та поширення конфіденційної інформації про особу (без її згоди), про що йдеться у частині 2 статті 32 Конституції, доречні, адже в цьому випадку мовиться про права особи, а також можливі подробиці її інтимного життя. Тому інформація, яка розголошена без згоди особи може негативно вплинути на спосіб існування людини, її родинний стан та багато інших чинників. Тільки згода самої особи дає можливість розпоряджатися інформацією про неї, за винятком випадків збирання інформації при проведенні слідства, дізнання та оперативно-розшукових заходів.

Серед конфіденційної інформації особливу вагу має інформація професійного характеру. В чинному законодавстві передбачені суворі обмеження, які стосуються цієї інформації та засобів її розголошення. Так згідно з Законом України "Про основи законодавства України про охорону здоров'я" зазначено, що медичні працівники та інші особи, яким у зв'язку з виконанням професійних або службових обов'язків стало відомо про хворобу, медичне обстеження, огляд та їх результати, інтимну і сімейну сторони життя громадянина, не мають права розголошувати ці відомості, крім передбачених законодавчими актами випадків. Так само в Законі України "Про нотаріат" обумовлено, що нотаріуси та інші посадові особи, які вчиняють нотаріальні дії, зобов'язані додержувати таємниці цих дій. Обов'язок додержання таємниці вчинюваних нотаріальних дій поширюється також на осіб, яким про ці дії стало відомо у зв'язку з виконанням ними службових обов'язків. Довідки про вчинені нотаріальні дії та документи видаються тільки на письмову вимогу суду, арбітражного суду, прокуратури, органів дізнання і слідства у зв'язку з кримінальними, цивільними або господарськими справами.
Професійними таємницями вважаються також таємниці: сповіді, довіреному священнослужителю; судового захисту; попереднього слідства; усиновлення та інше.

Конституція передбачає право кожного громадянина на ознайомлення з інформацією про себе, яке і пов'язане з діяльністю не тільки органів державної влади, місцевого самоврядування, а й установ і організацій усіх форм власності. Відповідно до статті 31 Закону України "Про інформацію" громадяни мають право доступу до інформації про них, заперечувати її правильність, повноту, доречність тощо.
Органи державної влади, місцевого самоврядування, установи та організації, які мають інформацію про громадян, зобов'язані надавати її безпосередньо і безкоштовно на вимогу осіб, яких вона стосується, крім випадків, передбачених законом, а також вживати заходів щодо запобігання несанкціонованому доступу до неї.

Відмова в доступі до такої інформації або приховування її, незаконне збирання, використання, зберігання чи її поширення можуть бути оскаржені до суду. Гарантія на судовий захист права спростовувати неправдиву інформацію та вимагати вилучення будь-якої інформації підкріплюється вимогами статті 49 Закону України "Про інформацію". Право на відшкодування матеріальної та моральної шкоди, завданої збиранням, збереженням, використанням та поширенням такої інформації, міститься у Цивільному кодексі та гарантується статтею 56 Конституції України.
