Dura lex sed lex es una frase latina que significa “la ley es dura, pero es la ley”.
Mi hijo tiene una condición que es T.E.A., y está catálogada como una discapacidad intelectual.
Por esta discapacidad, hay un bono gubernamental que recibe desde hace cuatro años.
El gobierno le otorga $ 4.5 , mensuales. Un poco más que la pensión de vejez, que me pagan a mi.
Por su condición cognitiva , la página permitia la transferencia a mi cuenta. En este mes de julio la página, eliminó la opción de transferir y hay que abrirle una cuenta bancaria individual.
Fui al Banco a realizar esa diligencia, y me consigo, con que existe una Ley, dónde hay que nombrarle un tutor, y esto lo hace un tribunal. Yo no puedo manejarle su cuenta, por qué no tengo autorización.
Mi hijo tiene 29 años, y desde que nació solo yo me he ocupado de él y me entero de repente, que un juez es el que va a decidir si se le abre o no la cuenta y quien la va a movilizar. Y entonces?
Bueno aquí comenzó mi proceso, cuando yo estudié ví siete materias de leyes, y ya una vez graduada seguí en el mundo de las leyes. Por qué un Contador Público, está obligado a saber dónde está parado.
Según mis conocimientos, yo era la obligada a asistirlo, de hecho, de derecho y por qué así lo quise yo.
Ahora , a partir del año 2007. Son unos señores desconocidos los que toman decisiones en mi hijo, al cual ellos no conocen ni conocerán porque no está en mis planes, tomar un segundo de mi tiempo en eso.
Le pregunté a un colega amigo, que también es abogado y algo así me respondió, " tu eres la mamá, pero es la notaría , la que aprueba quien lo va a representar por la condición que el presenta", .Dura lex sed lex es una frase latina que significa “la ley es dura, pero es la ley”.
Le hice el comentario a mi prima, ella también es abogada y se encuentra en el vecino país.
Y me respondió así, " mira prima , si es justo o no , no tiene sentido desgastarse en eso, así está establecido en la Ley ".
Que maravilla, así existan los progenitores, hay que nombrarle un tutor o responsable. Yo me ocupé de revisar y existe una ley de discapacidad desde el año 2006, lo cual no he podido terminar de leer.
En ese año la institución donde yo lleve a mi hijo durante trece años, me indicaron por escrito que tenía que sacarle un carnet, y era obligatorio, creo que todos los representantes de los niños lo hicieron, yo sé que yo no lo quise hacer .
Lo hice en enero del año 2020, porque fue una jornada que hicieron a cuatro cuadras de mi casa, se me hizo fácil llevar a mi hijo, luego de que ya todos los demás tuvieran su carnet y solo faltara mi hijo por el mismo , así fue como me lo atendieron no más llegando.
Yo estuve yendo y viniendo a la institución, que es un C.A.I.P.A. que está en mi urbanización, hasta que ví que ya faltaban muy pocos ya se habían ido casi todos y así mi hijo no se alteraría por la cantidad de personas. Y así fue como saque ese carnet.
En este C.A.I.P.A. nunca me lo recibieron, por eso busque atención en un privado, el cual es excelente.
Aquí en C.A.I.P.A. solo los reciben hasta los doce años , y pocas horas a la semana , nada más de lunes a jueves. No vale la pena.
Le abrieron la cuenta por una excepción y con la salvedad de que yo consiga la autorización del tribunal algún día.
Algún día que yo me sienta con mucho ánimo y disposición de hacer semejante diligencia.
El gobierno lo único que ofrece es un carnet que no tiene utilidad alguna y una Ley , que solo me da trabas , dificultades y sinsabores.
