Nintendo and Square Enix seem to be the most legal minded when it comes to fans. Nintendo still holds the lead quite a bit there in that regard.

I think Sega and Capcom are probably the most fan supportive in regards to rom hacks and mods. I mean, Capcom has even worked with fans to create special anniversary editions of one of the Street Fighter II games on Super Nintendo. We won't see Nintendo doing that anytime soon.
