After disclosing power management features were added to slow down older iPhones, two Los Angeles residents filed a lawsuit against the giant.
Defendant breached the implied contracts it made with Plaintiffs and Class Members by purposefully slowing down older iPhone models when new models come out and by failing to properly disclose that at the time of that the parties entered into an agreement.

Apple recently disclosed that version of iOS 10.2.1 and higher will slow down the performance of older devices to help deal with aging hardware, specifically old batteries.
"Our goal is to deliver the best experience for customers, which includes overall performance and prolonging the life of their devices. Lithium-ion batteries become less capable of supplying peak current demands when in cold conditions, have a low battery charge or as they age over time, which can result in the device unexpectedly shutting down to protect its electronic components.
Last year we released a feature for iPhone 6, iPhone 6s and iPhone SE to smooth out the instantaneous peaks only when needed to prevent the device from unexpectedly shutting down during these conditions. We've now extended that feature to iPhone 7 with iOS 11.2, and plan to add support for other products in the future."

Although Apple didn't properly disclose this feature, I suspect they won't have much success in the lawsuit as they are claiming it is when new devices are released. Apple has been actively power managing iPhones since the beginning, this is a more aggressive feature to deal with the performance issues old batteries present. If you owned an iPhone for more than 3 months, you know how quick the batteries become shit.
I personally would like to see a class action for the iPhone 6/6S, they acknowledged battery issues but many devices with battery issues don't fall under the serial numbers for a free replacement. Every mobile Apple device has been plagued with battery issues shortly (6 months or so) after purchase.
