Like any situation in life there are different perspectives. With the three mentioned items that most people recognize as being in the Declaration of Independence of Life, Liberty, and the pursuit of happiness comes an implied sense of responsibility.
I would rather we have to deal with those few who don't act responsibly than to deny all of us from such things like fireworks, or more importantly ,firearms and ammunition. The founders of the country realized this and we need to remember that back then the people decided the law. Common law worked because the people in the form of juries decided punishment for law breakers. The other key part of the law was that there had to be an injured party.
Today the laws are nearly all victimless and just another hidden tax on the people disguised as law.

The other thing that people forget about the past is that the courts were when people couldn't settle things privately after trying too. It was the last thing resorted too rather than the first like it seems now is done.
So in your example of your hay field being burned up by some careless kid who's parents have nothing to compensate your loss, whale away on the kid then whip the parents asses too. It won't replace your hay but you should feel somewhat better having given them an education in fireworks safety so next year you shouldn't have to worry about.
