False cases are on rise India. Many people are going through legal tussle since many years and yet to get any resolution. Going through such such long process is very traumatic. Noone wants to be in legal matters and some does that for fun. Recently, I came across a news where a girl, files multiple false legal cases against different male friends and levied rape and other abuse charges. She was like living on the false claims and getting compensation from the courts. It is strange how people are misutilising the judiciary system for their own venefits. She was using the legal matters as a way of making money for herself.

When it comes to get into legal matters, a person can sue when they have a legal claim, or "cause of action", and can prove their claims. For example, someone might sue for a personal injury if they were injured in a car accident and the other driver was responsible. In this case, the injured person would need to provide evidence of their injuries, such as medical records, police reports, and witness statements. The opposing party could then present a defense or file a counterclaim.

In my country the legal matters are always a long running process. One can not get the judgement in a matter of time. A person always needs to consider many things before dragging anyone into the court matters. Or in case they were already been dragged by other party, it is sensible to negotiate the matters outside the court. It is important to decide if going through the legal process is worth the effort. A person can not just #sue someone for things they do not like, but instead must show that the other party violated a rule or requirement that harmed them in a way that can be compensated. But looking the lawsuit procedure, it is alwsys advisable to keep away from such things as much as possible.

Looking at the daunting and traumatic legal long procedure, I have alwsys find my Dad avoided being into legal matters. And so does me. It was like either you let the case goes or ready to bear the loss or to forgive. My Dad alwsys open any of these option. I never seen him "suing" anyone, neither he was sued by others. Even though he was cheated multiple times, he prefer to forgive. Just only, he does not have enough time to get into legal. tussle. Instead he preferred forgiving. He was true example of forgiveness.

Forgiveness is a voluntary process of letting go of negative feelings towards someone who has wronged you.

In villages, people are in habit of capturing lands. They were alwsys ready to fight , but my dad let such things to go. If I am not wrong, we are already let many acres of land to others. My Dad used to say , atleast someone is utilising them for their livlihood. He had this attitude, because he was into job and others were not. He was like "whatever we have let's be happy with it. Do not ask for more, as it will create mental disturbance and hamper our Peace". Honestly, looking at this approach, I was shocked and surprised but later realised what he meant. Some of the cases were sorted through mutual tslking and understanding. Pulling into these matters to court is not going to be fruitful and took a number od days for the outcome.

A friendly reminder!

This makes it important to analyze the situation and matters, before deciding whether to sue someone, we should consider the following factors:

  • Case: Do you have a good case?

  • Settlement: Would you be satisfied with a settlement or dispute resolution?

  • Judgment: If you win, will you be able to collect the judgment?

  • Cost: Lawsuits can be expensive, involving lawyers, trials, evidence, and expert testimony. Even if you win, the compensation you receive may not cover the costs of the lawsuit.

  • Emotional impact: The claims process can be stressful and anxiety-inducing, and may require reliving the accident or injuries.

  • Alternatives: Are there other ways to resolve the issue, such as mediation?

If we cannot answer any of these questions positively, we may want to reconsider taking legal action.
