Whether a Statement of Defence is required to challenge locus standi

The only way the capacity or locus of the Plaintiff to sue is to file a statement of defence which’ will meet the averment in the statement of claim headlong and disclose incompetence to file the suit. Without the statement of defence there was no way the Judge could have been able to determine the issue of locus standi in the circumstance.
