It's happened, I recently wrote a post in regards to when boundary disputes occur and the damaging impacts they can have on design and the finished product of your home. I've been conscious of this fact since my neighbours have commenced building. They're building with a cheaper lower grade builder. To give you and idea of the company. Their CEO took a yacht to far north Queensland from southern Victorian state to escape quarantine..
At that stage the waters weren't being monitored only cars and planes were being grounded, no one anticipated that a rich elite would use their yacht to escape.
So today as my neighbours house has been nearing completion and I'm about to start I went hunting for my parameter boundaries which I already knew went missing. But I needed a closer look.
Upon inspection I noticed that my neighbours builders had completely dug out my front peg.
I also did a bit of digging on the other side of my land to locate the other one. Noting that the temp fence and pink marker do not even come anywhere close. The same building company has taken a meter of my land.
I began measuring my frontage as I have a 14 meter block and shock and behold I only now have 13 meter frontage. An entire meter has been taken from my neighbour who has built their garage on my land.
This whole issue will now push my house over and I will possibly not be able to build the home I just signed the contract for.
I contacted the site supervisor who is overseeing the building of the two properties and noting he didnt respond in text but he phoned me straight away. The usual conversation prevailed where it is not his issue and that it was mine. This isn't the first time I had a run in with this builder as previously he has denied any and all wrong doing he has also told me to "get #$%&" over a rubbish dispute that his builders were using my block as a construction tip.
This was quite the alarming response from a professional building company listed on the stock market that was supposed to be a leading Australian builder. I'm quite shocked and happy that we are paying a little more for our builders. I guess it is true you really do get what you pay for.
The shocking aspect of this situation is that my house most likely won't fit on my block and I'm not certain where to go to next. I phoned the developer and they were aware that there were significant issues with this building company and that a number of home owners were making complaints. The area had also experienced an extremely high incidence of construction waste being dumped.
The entire thing has been caught on CCTV but the company is refusing to release the CCTV footage which is leading me to believe it was someone associated with them.
The estate requirements also had a specification that homes had a 200mm set back from the boundary. I have further requested and received a copy of my neighbours plans which indicate that they received approval based on their home being built 200mm away from the boundary line. But in reality their home is not 200mm away from the boundary line.
I take some solice in the fact I have picked it up early and I can commence action but I have no idea what the future holds as I don't believe they're going to tear down a house and rebuild it.
This is such a shocking story and I haven't even started building yet.
