The fight for boundaries continues and I'm getting quite concerned at the moment. I recently had to have my site boundaries redrawn up as I was contesting my neighbours build. Estate requirements were for a 200 set back at a minimum and as the home was being constructed I was constantly raising that the property was too close to the boundary and would impact my home that we are about to build.
Furthermore the over head guttering extends beyond the boundaries and into my property, as these are Melbourne land sizes homes are designer built to block sizes incorporating all requirements. Any discrepancies will blow out the entire build and design. Not to mention this is a dual drive way so this massive over build will impact my ability to access my property.
The same builders are building my other neighbours property and as you can see from the studs in the ground my neighbours builders have claimed about a meter of my land. This will have massive consequences in the construction of my home and will no doubt cause the appearance of the previous post of the 3 homes touching.
I've gone out and purchased a really expensive home from a boutique building company and I hate to sound privileged but I don't want it's look and feel to be impacted by other people's brick work. Everyone builds to their own likes and needs and I went to alot of trouble for my perfect.
I initially contacted my neighbour whose home is being built and they denied any of it ontop of it they denied removing the boundary pins. I fear it was a deliberate move so that by the time I came onto site the builders would be gone and nothing could be done. They are also refusing to provide me the fee for the resurvey which under the law they must as it is an offence under the fencing act.
Without any traction I contacted her builds project manager whom I had been engaging with due to the large amounts of construction waste being dumped on my land in the construction of these two homes. My home being in the middle was being used as a cross over and being trashed.
It was infuriating! I have worked hard for 20 years for this moment and to have some idiot totally disrespect my small patch of land was abhorrent.
This is the location of where our boundary peg was supposed to be located but was removed and when I raised it with the builders they denied doing it. An odd stance because they have been on site since November and no one else would have done it. I've been forced to pay over $1200 to resurvey the land and it will cost me in excess of $5000 to clear the construction waste off my property, funds I do not have available to me.
I found my removed and discarded site peg on one of the pile of rubbish that was dumped on my block. A sign that the builders were being unprofessional and dishonest.
The biggest issue I find is that my neighbour who is building next to us has not attempted to resolve the matter and instead also taken to denying it when the pictures are crystal clear.
I have escalated the matter to the Victorian Building Authority and I will be engaging a lawyer as I am absolutely distraught at what is occurring.
They say building is a stressful endeavour but we haven't even started building yet, these are my neighbours properties!
Does anyone else have any shocking stories? How did you deal with them?
