Hola amigos de Home Edders. Hoy quiero referirme a un tema que ya he tocado antes pero de manera muy general en otros post y del cual se habla mucho en estos días, como son los derechos humanos. Este mis queridos amigos es un tema que los invito a conocer y a vivir, para entender un poco más de nuestro paso significativo por este el mundo, que nos rodea y que es nuestro.

These are a set of rights that, over time, have been recognised by the international institutions in charge of verifying their correct exercise, and I say recognised because they are rights that by their nature are directly linked to human life, they are not created or added. They are born with us. Human rights have progressed since the first documents that enunciated them, the most significant being the Universal Declaration of the Rights of Man and of the Citizen published after the French Revolution in 1789.
Estos son un conjunto de derechos que a lo largo del tiempo, han sido reconocidos por las instituciones internacionales encargadas de verificar su correcto ejercicio, y digo reconocidos porque son derechos que por su naturaleza están ligados directamente a la vida humana, no son creados ni añadidos. Nacen con nosotros. Los derechos humanos han ido avanzando desde los primeros documentos que los enunciaron, siendo el más significativo la Declaración Universal de los Derechos del Hombre y del Ciudadano publicada con posterioridad a la Revolución Francesa en 1789.
These first rights referred to the rights most intrinsic to the human condition and to the most personal sphere, and then went on to include civil, political, labour, social and environmental rights, among others, always under the conception that rights exist, to be respected when living in a community or in society.
Estos primeros derechos se refirieron a los derechos más intrínsecos a la condición humana y a su ámbito más personal, para luego ir abarcando los derechos civiles, políticos, laborales, sociales y ambientales entre otros, siempre bajo la concepción de que los derechos existen, para ser respetados al vivir en comunidad o en sociedad.
This perception of these rights is no different from any other right, only that they are recognised with respect to any human being anywhere in the world, with the obligation of the states (as a political construction) to respect the exercise of such rights, for which there is a common legal regulation for their protection, which does not occur with the rest of the rights that will only have application in the specific country that recognises them, almost always associated with nationality and territoriality.
Esa percepción de estos derechos no es distinta de cualquier otro derecho, solo que son reconocidos respecto de cualquier ser humano en cualquier lugar del mundo, teniendo la obligación los estados (como construcción política) respetar el ejercicio de tales derechos, existiendo para ello, una normativa legal común para su protección , lo cual no ocurre con el resto de los derechos que solo tendrán aplicación en el país en específico que los reconoce, asociado casi siempre a nacionalidad y territorialidad.

Thus we have that every human being, regardless of gender or country, has in principle the right to life, liberty, equality, freedom of expression and opinion, and to have their rights limited only by the common good. These are the most basic human rights that must be respected and guaranteed by the states that are part of the Universal System of Human Rights or the Inter-American System of Human Rights, and from these are based the others that, later on, with the evolution of society and modern life, were recognised as part of human development. It should be pointed out that human rights are only violated by states as a geo-political construct, not by individuals among themselves.
Así tenemos que todo ser humano independientemente de su género, y del país donde se encuentre, tiene en principio, derecho a la vida, a la libertad, a la igualdad, a la libertad de expresión y opinión, y a qué sus derechos no sean limitados más que por el bien común. Éstos, son los derechos humanos más básicos que deben ser respetados y garantizados por los estados que forman parte del Sistema Universal de Derechos Humanos o del Sistema Interamericano de Derechos Humanos, y de estos parten los demás que, posteriormente con la evolución de la sociedad y la vida moderna, se fueron reconociendo como parte del desarrollo humano. Hay que indicar que los Derechos Humanos solo son violentados por los Estados como construcción Geo política, no por los particulares entre sí.
How can I claim a labour right if I have no freedom of expression? How can I claim a civil or political right if I fear that the state will make an attempt on my life? How can I demand a social right if I am not recognised as an equal to my fellow human being? It is not by chance that this has been the structure given to the global recognition of these rights, which for me are not more important than the other human rights, but form the first sphere of protection that every human being must have in order to be able to exercise the other natural rights that he or she has.
¿Cómo puedo reclamar un derecho laboral si no tengo libertad de expresión? ¿cómo puedo reclamar un derecho civil o político si temo por qué el estado atente contra mi vida? ¿cómo exijo un derecho social si no soy reconocido como igual a mi semejante? No es casual que está haya sido la estructura que se le ha dado al reconocimiento global de estos derechos, los cuales para mí no son más importantes que los demás derechos humanos, sino que conforman la primera esfera de protección que debe tener todo ser humano para poder ejercer los demás derechos naturales que tiene.
As a human being, a citizen, a member of a family and a legal professional, I believe that these so-called first generation rights must be well known by all of us to be able to exercise them, or to defend and demand them, in order to advance towards civil, political, labour, social, environmental, telecommunications and other rights. Experience has told me that we do not value or protect what we do not know, and to conclude, let me tell you that the family is a human right, hence the importance of this post being here and not elsewhere, because the family is also the place where our rights begin and where we learn.
Como ser humano, ciudadana, miembro de una familia y profesional del derecho, creo que estos derechos llamados de primera generación, deben ser conocidos muy bien por todos nosotros para poderlos ejercer, o defender y exigir, para avanzar hacia los derechos civiles, políticos, laborales, sociales, ambientales, de telecomunicaciones y otros. La experiencia me ha dicho que no valoramos ni protegemos lo que no conocemos, y para finalizar déjenme decirles que la familia es un derecho humano de allí la importancia de que este post este aquí y no en otro lugar porque adicionalmente es la familia el lugar donde inician y aprendemos nuestros derechos.
