尊敬的并各位领导:
您们好！我们系大同城区大十字街凤凰嘉园小区业主，就政府拆迁安置悖理违法一事提出诉求。
大同市凤凰嘉园小区系2003年竣工的商品房住宅小区，现居住着八百多户居民，共16栋楼。政府的这次拆迁征收，我们大多数居民不愿意被征收搬迁。理由如下:
一、我们小区是十年新房，房屋当年是华建集团承建，质量在同期房屋中胜优。这样的房子被拆迁将会浪费极大的社会成本和个人生活成本。
二、小区居民25%左右世代居住在这里，2003年城市改造回迁于此，因为地理位置优越，当时购买此小区也是大同最贵的小区，这些拆迁就地安置户，他们已经经历过一次拆迁的经济损失，刚刚住了十几年又要拆迁老百姓心在滴血呀！
三、商品房房屋所有权是七十年产权。从法律角度讲，政府应遵守契约精神，不能随便毁约。现房屋仅仅十四年房龄，政府就单方面毁约，置名意于何地？
四、小区里有很大一部分是老年人，一直选择居住在这里，就是为了方便生活、方便就医、方便健身等。他们不愿意离开，不愿意脱离周边优质的公共资源，更不愿意在耄耋之年承受沉重的拆迁负担。
五、2017年大同市城市规划第二十一条指出，凤凰嘉园片区属于优化片区，“这些片区建成年代较晚，质量相对较好，不必进行大面积拆除重建。而是我通过传统符号和要素等方式，对建筑风貌和周边环境进行改造优化。”。政府不该出尔反尔，不出一年政策再变。
六、大同市政府发出的摸底登记、征收通告，在程序、赔偿、合法性等方面存在严重不合理、不合法。摸底登记五天，摸底结果没有公布，拆迁公告倒是先出来了。而公告中赔偿标准的依据又是什么呢？我们一类地段给三类的房子补偿款及不合理，根本就买不了我们目前这么大的房子，这里不是棚户区，房屋质量像坚固的堡垒，所以我们不愿意搬离。
鉴于以上因素，广大业主联名诉求。恳请政府认识到民心不可违、民意不可欺、民财不可侵，还凤凰嘉园业主们一个公道，让凤凰嘉园的居民能够安居乐业。
