MOST PEOPLE FAIL TO REALIZE that
Birth Certificates are commercial paper, and the way they collect on that instrument, is that they drag you to court on some statutory violation, while SILENTLY asserting to be the holder in due course.Which means that commercial (UCC) defenses can be used, such as a COUNTER-DEMAND.
BTW, in the "rule" below, YOU are the ISSUER, since you (or your guardian) SIGNED the Birth Certificate, and the United States is the POSSESSOR.
"THE FUNDAMENTAL “RULE” OF COMMERCIAL PAPER
The possessor of a piece of commercial paper has an unconditional right to be paid, as long as:
(1)the paper is negotiable;
(2)it has been negotiated to the possessor;
(3)the possessor is a holder in due course; and
(4) the issuer cannot claim a valid defense."
*********
Oh, and when they take something subject to your CLAIMS and DEFENSES (such as reservation of rights), they're NOT "Holder in Due Course".
