Will ETH be classified as a security? I don't think so but we will see!
The Howey Test will determin if ETH is a security or not.
The second point is hard to proof because you can just say that you bought into ETH for its utility.
It might also be that the initial ICO gets classified as a security but not ETH in it's current state. So the ETH foundation might end up paying a penalty or sth. like that. We will see!
I also don't think that the USA want's to cut themself out of the blockchain space by classifying ETH as security. Most of the Altcoins run on ETH at the moment!
The Lawyers of ETH clearly stated that ETH is not a security. Most of the professionals think that ETH does not classify as a security. I will personally hold all my ETH and if it drops just add to my position?
