I actually remember a case that SCOTUS used 'common law' in a ruling (No, I don't remember who wrote the opinion.)

It was what turned out to be the end of the pornography debate. The Supreme Court decided that what was obscene would be decided by Community Standards. I believe they were just sick and tired of deciding 2 or 3 pornography cases per term.

I actually got involved in a case of community standards. The Swedish film "I am Curious" (I saw the 'yellow' version. The films distributor showed various versions to account for differing mores). The police in Spokane, Wa raided the showing I was at and EVERYBODY had to show ID. Well, not only was I curious, I was underage for the showing. I will tell you that community standards were discussed at my house. I had clearly violated the standards of the community I was most closely affiliated with at the time. I was on the shit list for that infraction for more than just a little while...

So. For my understanding, common law is merely ignored, not deceased. I hope.
