No real defense can ever be given unless you also have the right to face your accuser or to have evidence of an individual or individual victims. Until there is an individual victim or evidence leading to an individual victim you can never put up a true defense. If an individual gun downs a group of people in a McDonald's then he/she does not get charged with hurting society. No, he/she gets charged and judged on each individual count of murder. Why should the case be different in any other situation? Anything else has to involve a conflict of interest because you can't hurt the state and expect a fair trial from them at the same time. Look, you might not like things like hard drugs (very few people do) but heavy drug use is a sickness. You can't expect to kidnap people off the street, lock them up in cages, wreck their lives with a lifetime record that follows them everywhere they go and expect things to get better. We already tried this with alcoholism and it was a huge failure. Most people don't know this but in the last century governments around the world have killed over 100 million of their people and lock up untold numbers of people in the name of social change. The war on drugs has been going on this way for over 40 years now and it's been a total waste of lives and tax dollars. Police are not mental health professionals and have no business deciding what should go into our bodies.
