INTRODUCTION

[EN] : This morning, I received a comment upon a photo : « Your photo is stunning! Can I download it for my wallpaper screen? ». To be honest, in my photography past, this question is a recurring question. My first answer is : NO! But today, I am going to go further and explain why I have such reaction, and basically, I think most good photographers will understand my points of view. I will try in this post to stay focus on the main topic : what is my photo value if published on the internet? For this, I will follow this plan : - What are the limits of my intellectual property? - What is the accounting value of my photo? - What is the artistic value? - How can I protect myself from photo stealing?

And so I will conclude: how to buy my work fairly?

[FR] : Ce matin, j’ai reçu un commentaire sur une de mes photos : « Whaoo magnifique! Est-ce que je peux la prendre pour mon fond d’écran? » Alors pour être honnête, c’est une question récurrente dans ma vie de photographe. Et ma première réaction est : NON! Mais aujourd’hui, je vais aller un peu plus loin dans mes réflexions et je pense que de nombreux photographes vont se reconnaitre dans mes propos. Et pour ne pas nous écarter du sujet, je répondrai à cette question : Que vaut ma photo publiée sur internet? en suivant le plan suivant :
Quelles sont les limites de ma propriété intellectuelle?
Quelle est la valeur comptable d’une de mes photos?
Quelle est sa valeur artistique?
Comment me protéger du vol de photos?
Et de conclure : Comment acheter mes photos en tout bien et tout honneur?

LIMITS OF MY INTELLECTUAL PROPERTY? / LIMITES DE MA PROPRIETE INTELLECTUELLE?

[EN ] : A photo, whatever its success or its quality, has only one owner : the photographer. This is the basic rules, applied all over the world. What does that mean? That means that I am the only one who can use it, sell it, licensee it or print it. No one else. I might repeat for low minded people : NO ONE ELSE. Most people think that publishing a photo on the internet (Facebook, Steemit, Instagram etc…) gives right to viewers to use it, download it, and in some specific case make money with it. And they will all argue the same : « while publishing, you accept it is a free use! ». So let’s clarify the things : This idea is totally wrong. And totally illegal. Let’s have another example to understand. Do you think that the Rolling Stones give you any partial or total rights on their music while publishing in the internet their last disc? No and it seems obvious to you in this case. Photography is the same! Of course, artists, musicians, painters, photographers, writers are used to be stolen as the means to do it are so easy with internet nowadays. Why paying to see a movie although you can see it for free with a streaming channel? Why? First I will answer basically because this is the law. But most of you don’t care about it. On the second hand, I would say : while stealing our work, you refrain us to do more as producing an artistic or intellectual product has a real cost. And I am going to detail this.

[FR] : Une photo, quelque soit son succès ou sa qualité vraie n’a qu’un seul propriétaire : le photographe. Ceci est une règle simple, et appliquée dans le monde entier. Qu’est-ce que cela sous entend? Cela veut simplement dire que je suis le seul à pouvoir en disposer, la vendre, en faire des licences ou l’imprimer. Et personne d’autre! Au risque de me répéter pour les simples d’esprit: PERSONNE D’AUTRE!
La plupart des gens pensent que publier sur les réseaux sociaux fait tomber l’image dans le domaine public et que donc le spectateur peut en faire ce qu’il veut à son tour. Certains allant jusqu’à en faire du business dessus! Et ces gens vous diront tous la même chose : « en publiant, tu as accepté que cela tombe dans le domaine public ». Alors on va rétablir les choses: ceci est totalement faux! Prenons un autre exemple pour mieux comprendre : Croyez vous sincèrement que les Rolling stones abandonnent le moindre droit en mettant en ligne leur dernier album? Non et dans ce cas, cela vous parait évident. Et bien c’est la même chose pour les photographes!

WHAT IS THE ACCOUNTING VALUE OF MY WORK? QUELLE EST LA VALEUR COMPTABLE DE MA PRODUCTION?

[EN] : Making a photo could be value to zero as it is so easy for everybody to make one with its smartphone. But does your picture look like mine? Of course not. To publish a picture, I have to take into account its background cost (here in my case) : 40,000$ in cameras, computers and software 15 years of experience direct cost per photo as electricity, editing time, etc…

Since I quote these figures, you understand a professional or even mid level amateur photography has a cost!!!! A cost means it must have a value! Let’s have an example with one of my photo (see below)

You might like it or not but it is a film photography. To get such picture, I used my Tortuga camera (3000$) and a roll film (12$ for 2 photos), I spent 8$ to develop it and two hours to scan it and correct various points.

Low minded people could tell me at this stage : oh, I ignored that. And I will tell you : stop lying to me! You did not know the real cost for sure, but you know it has a cost. If you want to use a bike, you have to buy it. And it seems obvious as it is a physical product. But intellectual work are exactly the same. Each work has a production cost and by so can not be valued at zero!

[FR] : Faire une photo pourrait n’avoir aucune valeur tant il est facile pour tout à chacun d’en faire une avec son smartphone. Mais sincèrement, fait on les mêmes photos? Bien sûr que non. Et à chaque fois qu’un professionnel publie une photo, il faut prendre en compte son coût et les investissements : (dans mon cas):
40,000$ de matériels photo, ordinateur et logiciels
15 ans d’expérience professionnelle
le coût direct d’une photo : le temps de traitement, l’électricité,etc…
En citant ces chiffres, chacun comprendra qu’une photo faite par un professionnel ou amateur expert a donc un coût. Et qui dit coût, dit donc valeur! Prenons un exemple avec une de mes photos (voir ci-dessous).
On peut aimer ou ne pas aimer, mais pour faire cette photo, il m’a fallu un Tortura (3000$) et un film (12$), le faire développer (8$) et ensuite passer plus de deux heures à le scanner et corriger les petites imperfections.
Les simples d’esprit vont me dire à cette étape de mon raisonnement : oh, j’ignorai tout ça. Et je leur répondrai: arrêtez de vous foutre de la gueule du monde et de mentir. Vous ignoriez le coût réel, c’est certain mais vous ne pouviez ignorer que cela a un coût. Si vous voulez utiliser un vélo, vous devez l’acheter. Et cela semble évident car c’est un produit matériel. C’est la même chose pour les produits dits intellectuels. Chaque production a un coût et ne peut donc être gratuite!

WHAT IS THE ARTISTIC VALUE? / QUELLE EST MA VALEUR ARTISTIQUE?

[EN] : The artistic value of a work depends on the market demand. If I publish a photo that has no interest for anybody, its value is closed from zero (although it has a cost!). As soon as some of you want to buy it, the work gets a value that is defined by a relation between the artist and the buyer like for any other product. The price is fixed by so. But if you want to have one my photo for free, you just change its value by your own and without my agreement. that mostly means that you do not consider my work. As it should be free, it is only shit. so why would you download shit pictures? Be honest to you for once!

What is free? Looking at the picture is free. Commenting upon it also. Reblogging it also. Download it and use it even for personal purpose is illegal and not free.

[FR] : La valeur artistique d’une photo ou d’une oeuvre en général dépend du marché et donc de l’offre et de la demande. Si vous publiez une photo qui ne présente aucun intérêt pour personne, elle aura une valeur très proche de zéro (et ce bien qu’elle n’ait pas un coût de production nul). Dès lors que l’un d’entre vous souhaite l’acquérir, elle prend de la valeur et le prix du travail se définit dans une relation commerciale entre l’acheteur et l’artiste. Le prix en découle. Mais si vous partez du principe que mes photos sont gratuites, vous changez seuls les règles du jeu et ce sans mon accord. Si c’était gratuit d’ailleurs, ce serait de la merde, non? Alors pourquoi vouloir les télécharger? soyez honnête avec vous même pour une fois.
Qu’est-ce qui est gratuit alors? Regarder une photo est gratuit. La commenter, c’est gratuit aussi. La reblogguer également. La télécharger et l’utiliser pour quelconque usage même personnel est illégal et ne peut être gratuit.

HOW TO PROTECT MYSELF? / COMMENT SE PROTEGER?

[EN] : if someone is to have your work free, he will have it, but, doing two or three things, you discourage most of the stealers : always recall that your work is your own property and under copyrights (like this, nobody can tell you they ignored it) sign your work (although it takes me less than one minute with photoshop to get it off, it is not so obvious for everybody) publish low resolution picture (in my case, pictures are 1000pix wide maximum, which means it can just feet an ipad screen and no more! Above all, it avoids people to print it without a payment and my agreement)

[FR]: Si quelqu’un veut « piquer » votre contenu, il l’aura, mais, en faisant deux ou trois petites choses, vous pouvez en dissuader plus d’un :
d’abord remettre qu’il s’agit d’une oeuvre intellectuelle (la votre en l’occurence) et qu’elle est soumise à copyright (au moins ils ne pourront pas vous dire qu’ils ne savaient pas)
signer votre travail (même si enlever un filigrane me prend moins d’une minute sur photoshop, nombre de petits voleurs ne savent pas faire)
publier des résolutions très basses (maximum 1000 pixels, ce qui permet juste un fond d’écran sur un ipad et rien d’autre. En tout cas, cela évite que els gens impriment dans votre dos).

CONCLUSION IN CASE YOU STILL WANT ONE OF MY PHOTO / CONCLUSION AU CAS OU VOUS VOULEZ UNE DE MES PHOTOS

[EN] At this stage, you understand that my work has a cost, and if you have interest, it also has a value. You still want it? Why not asking simply what would be the price for such or such use? And in the first example, I think that I would totally agree the one who wanted my photo for its screen background after sending me 1 or 2 steems for example. As such, we will have make a fair exchange and everybody will feel comfortable. and in this particular case, I will give the buyer a his resolution link to be downloaded. A contract by the end!

So to people who writes me : super! can I download it? I will say: go to hell! Bloody you! And that is my conclusion as it has always been my view point on this topic. If you feel it could be free, I am no more interested in being in a discussion with you.

[FR] : A ce stade, vous comprenez que mon travail a un coût, et que si il vous intéresse, il a une valeur. Vous le voulez quand même? Alors pourquoi ne pas me poser la question et me proposer une offre? Revenons à notre example de ce matin, si la personne m’avait dit qu’elle me créditais d’un ou deux steems nul doute que nous aurions trouvé un accord et que je lui aurai mêmee envoyer le fichier dans la bonne résolution. Dans de telles conditions, tout le monde est légal et à l’aise. Au fond, ce n’est qu’un contrat.
Alors pour les gens qui m’écriront : super! Je peux la prendre? je répondrai systématiquement: va te faire foutre! Et ma conclusion n’est que le point de vue que je répète depuis des années. Si vous continuez à penser que tout est gratuit, je ne vais pas perdre mon temps à discuter avec vous. J’ai autre chose à faire.
