According to Article 33 of the Constitution of Ukraine:
Everyone who is legally on the territory of Ukraine is guaranteed freedom of movement, free choice of residence, the right to leave the territory of Ukraine freely, except for restrictions established by law.
A citizen of Ukraine may not be deprived of the right to return to Ukraine at any time.
The Constitution guarantees both citizens of Ukraine and all other persons legally present on its territory the right to freedom of movement, free choice of residence, to leave the territory of Ukraine at any time.
Some restrictions on the exercise of this right are established by the Law of Ukraine "On the Legal Status of Foreigners" and the Resolution of the Cabinet of Ministers of Ukraine "On the Rules of Entry of Foreigners into Ukraine, Their Exit from Ukraine and Transit through Its Territory".
The procedure for the movement of foreigners on the territory of Ukraine whose national passports are registered with the Ministry of Foreign Affairs or its representative offices shall be determined by this body. Foreign correspondents and journalists accredited to the press center of the Ministry of Foreign Affairs and members of their families travel on the territory of Ukraine in accordance with the procedure established by the same document. The stay of foreigners in areas with controlled entry is allowed on the basis of: visas for stay in Ukraine (where their specific address is determined), issued by diplomatic missions and consular posts of Ukraine abroad, unless otherwise provided by an international treaty of Ukraine.
As well as permits issued by the internal affairs bodies to foreigners who arrived in Ukraine at the invitation of the organizations to which they arrive on the basis of written appeals of these organizations, agreed in the prescribed manner.
Foreigners who arrived through permanent foreign missions or in private affairs or permanently reside in Ukraine, on the basis of their personal written application. Also, at the request of organizations that accept foreigners, these persons may be issued a permit for multiple entries to a specific address within the state.
These restrictions on movement and choice of residence are due to the need to ensure the security of Ukraine, public order, health, protection of the rights and legitimate interests of its citizens and other persons residing in Ukraine.
The Basic Law provides for the possibility of certain restrictions on freedom of movement and choice of residence for citizens of Ukraine and foreigners in a state of war or emergency. But these restrictions should be temporary and apply only during such a state (Article 64 of the Constitution of Ukraine).
These can be not only military circumstances, but also the outbreak of epidemics or pandemics in certain areas, the threat of natural phenomena (floods, earthquakes), and so on.
Every person who is on the territory of Ukraine has the right to voluntarily leave his / her place of residence or to leave the territory of Ukraine altogether. This also applies to refugees who have been granted asylum under Ukrainian law. Moreover, the state bodies of Ukraine are prohibited from expelling or forcibly returning refugees to a country where there were conditions on the basis of which they acquired refugee status.
The Law of Ukraine "On the Legal Status of Foreigners" provides for cases when persons may be prohibited from leaving the territory of Ukraine. These can be cases when foreigners are being investigated, pre-trial or a criminal case is being considered by a court, as well as other cases.
The departure of citizens of Ukraine from its territory is regulated by the Law "On the Procedure for Leaving Ukraine and Entering Ukraine by Citizens of Ukraine". This law meets the requirements of the current Constitution, according to which a citizen of Ukraine cannot be deprived of the right to return to Ukraine at any time. Public authorities are obliged to assist their citizens in returning them to Ukraine.
Згідно з статтею 33 Конституції України :
Кожному, хто на законних підставах перебуває на території України, гарантується свобода пересування, вільний вибір місця проживання, право вільно залишати територію України, за винятком обмежень, які встановлюються законом.
Громадянин України не може бути позбавлений права в будь-який час повернутися в Україну.
Конституція гарантує як громадянам України, так і всім іншим особам, що на законних підставах перебувають на її території право на свободу пересування, вільний вибір місця проживання, в будь-який час залишити територію України.
Деякі обмеження у здійсненні цього права, встановлені Законом України "Про правовий статус іноземців" та постановою Кабінету Міністрів України "Про Правила в'їзду іноземців в Україну, їх виїзду з України і транзитного проїзду через її територію".
Порядок пересування на території України іноземців, національні паспорти яких зареєстровані в Міністерстві закордонних справ чи його представництвах, визначається цим органом. Іноземні кореспонденти і журналісти, акредитовані при пресцентрі Міністерства закордонних справ, та члени їхніх сімей пересуваються на території України у порядку, встановленому цим же документом. Перебування іноземців у місцевостях з контрольованим порядком в'їзду дозволяється на підставі: віз для перебування в Україні (де визначена їх конкретна адреса), що видаються дипломатичними представництвами та консульськими установами України за кордоном, якщо інше не передбачено міжнародним договором України.
А також дозволів органів внутрішніх справ, що видається іноземцям, які прибули в Україну на запрошення організацій до яких вони прибувають на підставі письмових звернень цих організацій, погоджених у встановленому порядку.
Іноземцям, що прибули по лінії постійних іноземних представництв чи у приватних справах або постійно проживають в Україні, на підставі їх особистої письмової заяви. Також на прохання організацій, що приймають іноземців, цим особам може бути видано дозвіл на багаторазові в'їзди на конкретну адресу в межах держави.
Дані обмеження в пересуванні та виборі місця проживання зумовлені необхідністю забезпечення безпеки України, охорони громадського порядку, охорони здоров'я, захисту прав і законних інтересів її громадян та інших осіб, які проживають в Україні.
Основний Закон передбачає можливість окремих обмежень свободи пересування і вибору місця проживання для громадян України та іноземців в умовах воєнного або надзвичайного стану. Але ці обмеження мають бути тимчасовими і діяти тільки під час такого стану (стаття 64 Конституції України).
Це можуть бути не тільки воєнні обставини, а також спалах епідемій чи пандемії в окремих місцевостях, загроза з боку стихійних природних явищ (повінь, землетрус) тощо.
Кожна особа, яка знаходиться на території України, вправі добровільно залишити своє місце перебування або взагалі залишити територію України. Це стосується і біженців, яким згідно із законодавством України надано притулок. Причому державним органам України забороняється висилати або примусово повертати біженців до країни, де існували умови на підставі яких вони набули статусу біженця.
Законом України "Про правовий статус іноземців" передбачені випадки, коли особам може бути заборонено виїзд з території України. Це можуть бути випадки, коли відносно іноземців ведеться дізнання, попереднє слідство або розглядається судом кримінальна справа, а також інші випадки.
Виїзд громадян України з її території регулюється Законом "Про порядок виїзду з України і в'їзду в Україну громадян України". Цей закон відповідає вимогам чинної Конституції, за якими громадянин України не може бути позбавлений права в будь-який час повернутися в Україну. Державні органи зобов'язані надавати допомогу своїм громадянам у поверненні їх в Україну.
