It goies further back than the Fed. Just the idea of "incorporation" - literally "creating a body" by filing paper with a government - which allows a bunch of rich guys to avoid all responsibility for the actions of "the corporation", and the ridiculous patent and copyright laws, ensure that there will never be a "free market" for anything. As has been said before: if its punishable with a fine, that only means that it's ok for rich people to do it.
